PARKING – INTERLOCAL AGREEMENT WITH THE CITY OF DENTON, TEXAS

PERTINENT FACTS

The Texas Education Code, section 105.153, DELEGATION OF MUNICIPAL PARKING REGULATION, authorizes the City of Denton to delegate to the University the authority to regulate parking of vehicles on any public street running through or immediately adjacent to property owned or occupied and controlled by the University. The specific delegation is codified in the City of Denton Code at section 18-151 and 18-152.

As a part of the Fry Street Small Area Plan the University has been asked by the City to assume additional responsibility for regulation of parking in the Fry Street Area adjacent to campus. In conjunction with this request, the University was also offered the opportunity to assume responsibility for regulation of parking on several other streets adjacent to campus that were not previously contained within the City of Denton Code.

On June 19, 2001 in its regularly scheduled meeting, the Denton City Council authorized an amendment to the City of Denton Code sections 18-151 and 18-152 and directed the City Manager or his designee to execute an interlocal agreement, substantially in the form attached to this resolution, with the University.

Adoption of the interlocal agreement will transfer parking regulation in the Fry Street Area, and other designated streets on and adjacent to property owned or controlled by the University of North Texas, to the University.

RECOMMENDATION TO THE BOARD OF REGENTS

The President recommends, with the concurrence of the Chancellor, that the Board of Regents approve the attached Interlocal Agreement with the City of Denton, Texas, which delegates authority to regulate parking on the Denton public streets and property specified within the agreement to the University of North Texas.
