SUBJECT: UNT POLICY ON THE USE OF ALCOHOLIC BEVERAGES

APPLICABILITY: TOTAL UNIVERSITY

PHILOSOPHY

It is the responsibility of the University to maintain an environment which is conducive to teaching and learning and to personal and professional growth.  Since irresponsible use of alcoholic beverages is detrimental to the maintenance of an educational environment, it is the intent of the University to establish practices and procedures which discourage irresponsible use of alcoholic beverages and which ensure compliance with local, state and federal laws by all individuals on university property or facilities or property under the control or jurisdiction of the university.  While the decision to use or not to use alcoholic beverages is a matter of individual choice among persons of lawful age under State statutes, the university will attempt to encourage an environment where individual choice is coupled with responsible behavior and respect for the rights of those who choose to abstain.  While the University does not pursuant to the terms of this policy, require the filing of an Alcohol Use Request form by organizations when alcoholic beverages will be served at their events off campus, all members of the academic community are encouraged to consider this policy as a guideline for responsible and lawful behavior in conjunction with the use of alcoholic beverages.

STATEMENT OF  POLICY

A.Use or possession of alcoholic beverages at the University by any individual under the age of twenty one (21) is prohibited.  Failure to comply with this regulation violates State law and the Code of Student Conduct and may subject the individual to disciplinary action.

B.University employees are prohibited from consuming alcoholic beverages during their normal working hours in or on any property under the control or jurisdiction of the University of North Texas.  Any violation of this provision shall subject the employee to disciplinary action and the forfeiture provision of the appropriations bill which states that appropriated monies shall not be used for the payment of salaries to any employee who uses alcoholic beverages while on active duty.

C. Departments, student organizations, community individuals or private organizations desiring to sell, serve or consume any type of alcoholic beverage on campus must obtain permission in advance by means of the Alcohol Use Request form. 

 

Only the following exceptions will be made to the required filing of an Alcohol
Use Request:

  1. Private Residence Hall Rooms:  Persons of lawful age under Texas statutes may be permitted to possess and/or consume alcoholic beverages in the privacy of their rooms in the residence halls of the University, in accordance with the rules and regulations for residence hall living published by the Department of Housing and Residence Life.
  2.  University Union/Gateway Center:  Events scheduled for and presented in the University Union or the Gateway Center will not require a separate Alcohol Use Request form.
  3. Contract Leased Land:  Property leased by the University to another party
    is specifically excepted from this policy (i.e., current and future fraternity and sorority houses constructed on university property, the Radisson Hotel and Conference Center at the University of North Texas, etc.).

            Form availability:

Student Organizations:  Student Activities & Organizations Office, University Union

Departments:  Scheduling Services Office, University Union

Community Individuals/Private Organizations:  Scheduling Services, University Union or Conference Management, Gateway Center
                                                                                     
Request forms must be completed and returned to the respective office at least ten    
      (10) business days prior to date of event.   A copy of the approved Alcohol Use
      Request form must be available at any event where alcoholic beverages will be
      present as proof that permission has been granted.

D. Alcohol Use Request forms will not be approved for those areas of the campus which are designated as non-public or as instructional areas.  These areas  include but not restricted to offices, research areas, laboratories, music practice rooms, warehouse, stockrooms, shops, general service areas, mechanical rooms, the power plant, restrooms, studios, study rooms, hallways and classrooms.   

E. Alcohol Use Request forms must have the approval of the appropriate Dean, Vice President, Dean of Students or Department Director.  The University Police and Risk Management will be notified by Scheduling Services each  time a request for alcoholic beverage use on campus is approved.               

F.  On campus possession of open containers and consumption of beer, wine and/or distilled spirits by individuals is prohibited in all public areas of University owned or controlled facilities and grounds except for those specifically designated by this policy or those approved on a per event basis via the Alcohol Use Request form.

G.  The sale and consumption of alcoholic beverages may not commence before  
5:00 p.m. Monday through Friday and l:00 p.m. on Saturday and Sunday without written permission from the President.  All sales and consumption of alcoholic beverages must terminate by midnight Sunday through Friday and by  1:00 a.m. Saturday (Sunday morning).  All service of alcoholic beverages will terminate fifteen (15) minutes prior to bar closing.
        
GENERAL GUIDELINES

A. Alcoholic beverages donated to or purchased by the customer cannot be offered for resale.  Resale includes ticket sales, cash bars, donation bars, admission charges, door or cover charges – any money transaction.          

B. Security provided by the UNT Police Department may be required at the expense of the department, student organization, individual or private organization for events serving alcoholic beverages.  The number of officers required will be determined by the UNT Police Department.

C. All individuals attending an activity where alcoholic beverages are served, consumed or present must maintain on their persons appropriate proof of age.  A Texas driver’s license, a photo I.D. card issued by the State Department of Public Safety or an equivalent photo I.D. document from the state of residence will be accepted as evidence of age.

D. Hosting individuals and/or organizations, as well as individuals in attendance, are responsible for ensuring that any consumption of alcoholic beverages occurs in a lawful and responsible manner. 

UNT reserves the right to refuse service to any person who appears to be intoxicated, who incites a verbal or physical altercation or who lacks proper
identification for proof of age.  Should such action be warranted, the event host will be informed of the situation.   UNT reserves the right to take action necessary to resolve the situation, including contacting security and suspending alcoholic beverage service.

E.  Hosting individuals and/or organizations must provide non-alcoholic beverages and food in reasonable quantities at events where alcohol will be served, consumed or present.  All food and beverages must remain in the areas scheduled for said event.

F. The content of advertisements or promotions for any event at which alcoholic beverages will be served must not promote irresponsible consumption of alcoholic beverages.

G. Customer provided and/or donated alcoholic beverages must be delivered to function site no earlier than one hour prior to event.  All alcoholic beverages must be removed from premise at conclusion of event.
  
PROCEDURES FOR SCHEDULING ALCOHOLIC BEVERAGES

Definitions:   
Host Bar:  Service in which the host party/organization is responsible for all charges.
Cash Bar: Service in which each guest pays bartender for each drink as served.  Host responsible for bartenders, setups, and security.                                    

University Union and Gateway Center

Host Bar:  For events scheduled in the University Union or Gateway Center, the customer must purchase beer and /or wine and setups through Scheduling Services, University Union.  When desired, distilled spirits must be purchased from, or donated by, an off- campus supplier and delivered to the function site no earlier than one hour prior to event.
All alcoholic beverages must be removed from the premises at the conclusion of the event.

Cash Bar:  Beer/Wine only.  The customer must purchase beer and/or wine and setups through Scheduling Services for all cash bars scheduled in the University Union or
Gateway Center.  Distilled spirits cannot be made available for sale or served at any event where beer and wines are sold. 

Bartenders:  All alcoholic beverages being served in the University Union or Gateway
Center must be dispensed by a TABC certified bartender.  Arrangements for certified bartenders must be made through Scheduling Services.  The number of bartenders required will be determined by Scheduling Services.

Campus Buildings Other Than The University Union and Gateway Center

Host Bar:  Two options apply for departments, individuals or private organizations desiring to provide a host bar on campus at a location other than the University Union or Gateway Center:

     Option 1:

     Alcoholic beverages (beer/wine only) and setups may be arranged through Scheduling
     Services, University Union.  The purchase of a TABC Temporary Alcohol and
     Beverage Permit  will be required at least ten (10) business days prior to date
     of event.  Customer is required to provide Scheduling Services a map designating          
     the area in which alcohol service is requested at the time of event scheduling.
     When desired, distilled spirits must be purchased from, or donated by, an off-campus
     supplier and delivered to the function site no earlier than one hour prior to event.  All
     alcoholic beverages must be removed from the premises at the conclusion of the
     event.

      Bartenders:  All alcoholic beverages being served on campus must be dispensed by a
      TABC certified bartender.  Arrangements for certified bartenders must be made
      through Scheduling Services, University Union.  The number of bartenders required    
      will be determined by Scheduling Services.

      Option 2:

      Beer/wine/distilled spirits and setups may be provided by or donated to the customer.
      Alcoholic beverages must be delivered to the function site no earlier than one hour         
      Prior to the event.  All alcoholic beverages must be removed from the premises
      Immediately at the conclusion of the event.

      Bartenders:  All alcoholic beverages being served on campus must be dispensed by a
      TABC certified bartender. 

Cash Bar:  Cash bars scheduled outside the University Union or Gateway Center require a TABC Temporary Alcohol and Beverage Permit.  The purchase of the permit, alcoholic beverages (beer/wine) and setups must be made through Scheduling Services, University Union, at least ten (10) business days prior to date of event.  Customer is required to provide Scheduling Services a map designating the area in which alcohol service is requested at the time of event scheduling.  Distilled spirits cannot be made available for sale or served at any event where beer and wines are sold.

Bartenders:  All alcoholic beverages being served on campus must be dispensed by a TABC certified bartender.  Arrangements for certified bartenders must be made through Scheduling Services.  The number of bartenders required will be determined by Scheduling Services.

APPROVAL AUTHORITY AND EXEMPTIONS:  Notwithstanding anything to the contrary in any other policy and subject to compliance with State and Federal laws, the Chancellor or the President shall have the authority to approve the use or possession of alcoholic beverages in any area on campus or at any UNT System or University function, as well as to provide exemption from UNT System or University requirements pertaining to use or service of alcohol.

SANCTIONS

Individuals or groups violating this policy will be referred to the appropriate Vice President or to the Center for Student Rights and Responsibilities for disciplinary action under the Student Code of Conduct and/or employee regulations.
